BREXIT UPDATE Dear Partner With the 29th March 2019 upon us, we have still have no reassurances as to what procedures will be required, if the UK leaves the EU without a deal. Despite the position shifting almost daily, we feel it is necessary to discuss these points openly to ensure we are able to offer our Customers the best possible solutions. Phoenix are releasing information to UK Customers confirming that whilst we are well positioned to deal with these significant changes, as we already operate road freight services from/to Non-EU Conutries, arranging Customers clearance at port of entry and our Customs approved ETSF facility at our Basildon terminal. We are also advising them to gain an EORI number, we would suggest all Suppliers/Consignees your end do the same. Economic Operator Registration and Identification number (EORI) In order to continue trading with an EU business please register for a UK EORI number https://www.gov.uk/eori This normally takes 3-4 workings days for HMRC to confirm the application and provide your EORI number by email. We are also suggesting that all UK Consignees obtain TSP registration: Transitional Simplified Procedures HMRC have now issued “Transitional Simplified Procedures” to make it easier for the import of goods from the EU after the 29th March (subejct to No deal being agreed), to access this option you will be expected to register for these procedures as from 7th February but it is not compulsory. Transitional Simplified Procedures (TSP) for customs will make importing easier for an initial period of one year, should we leave the EU without a deal, to allow businesses time to prepare for usual import processes. If businesses are registered for TSP, they will be able to transport goods from the EU into the UK without having to make a full customs declaration at the border. Businesses can register for TSP if they: – Have an EORI number / Are established in the UK / Are importing goods from the EU into the UK The benefit of TSP will be: Duty is not payable in advance either by the forwarder, agent or importer. The importer has a direct account with HMRC, and the duty is collected directly. Customs clearance can also be done afterwards. So, if all importers on a groupage trailer are TSP registered, goods can be transported with no delays for clearance. A clearance still needs to be completed, but can be done after delivery. The importer can make the clearance themselves or instruct their forwarder to do. Also this will mean goods will not need to travel on a T form to the UK. All goods must of course be transported accompanied by a Commercial Invoice. Please ensure the Commercial Invoice contains the following information: Full name, address and contact details of the Shipper and Consignee / Include both Shipper and Consignee EORI numbers / Quantity, gross and net weight of goods / Number and type of packages / Values of goods, currency and Incoterms / Country of origin / Customs Commodity Codes. Another new legislation for EU to UK movements is called: Safety and Security declarations. The new rules only apply to goods coming from the EU. Importers will still be required to submit import declarations for customs purposes – which are not the same as Safety & Security (Entry Summary) Declarations. After a six-month transitional period, carriers will be legally responsible for ensuring Safety & Security Declarations are submitted pre-arrival to HMRC at the time specified by mode of transport. The road import Safety and Security declaration is a declaration that will be made to UK authorities advising them of the details of all shipments arriving in the UK by road. This declaration will be separate from the import customs declaration which is made by the importer of the goods. Making a safety and security declaration is the responsibility of the road haulage operator. The full requirement, currently suspended for six months, is that each and every consignment in a lorry has to have its own individual safety and security declaration submitted by the haulier. Each declaration includes up to 37 individual lines of information much of which duplicates information from customs declarations that will be submitted by importers to obtain a Movement Reference Number (MRN) from HMRC. Safety and Security Declarations for road freight must be submitted one hour prior to arrival in the UK. From you, our Partner, we would be delighted to receive your feedback.
